Privacy Agreement
This Privacy Agreement applies to the BMS Cloud Platform services provided by DAO EV Tech (“DAO EV Tech”, “we”, “us”) and sets out what data DAO EV Tech collects, why we collect it, how we use it, and how we protect it. What we do with that data and how we protect it. Your trust is important to us, and we understand how important personal information is to you. We will collect personal information from you to the extent that is reasonable and necessary in accordance with legal and regulatory requirements. We make every effort to prevent the leakage, destruction or loss of your information through reasonable and effective information security technology and management processes, and by taking appropriate security protection measures.
Definition.
1. personal information: refers to all kinds of information recorded electronically or otherwise that can identify a specific natural person or reflect the activities of a specific natural person, either alone or in combination with other information.
2. Sensitive personal information: including identification document numbers, personal biometric information, property information, movement traces, transaction information, and personal information of children under 14 years of age (inclusive). Sensitive information will be bolded and underlined in this agreement.
3. Personal information deletion: The act of removing personal information from the system involved in the realization of daily business functions, so that it remains unavailable for retrieval and access.
This Agreement applies to the DAO EV Tech BMS Cloud Platform service, which refers to the official DAO EV Tech BMS App operated by India DAO EV Tech Limited (hereinafter referred to as “DAO EV Tech Inc.”).
Please note that this Agreement does not apply to services provided to you by a third party, and if a third party provides services to you, the personal information you are required to provide to that third party service provider does not apply to this Agreement.
Before using DAO EV Tech BMS Cloud Platform services, please make sure you read and thoroughly understand this Agreement, especially the bolded and underlined terms. By accessing or using the DAO EV Tech BMS Cloud Platform Services, you are agreeing to this Privacy Agreement and relying on our treatment of your information. If you have any questions about this Agreement, you may contact us using the contact information provided in Section 9.1 of this Agreement. If you are a minor under the age of 18, please read this Agreement with a legal guardian and pay special attention to the terms of use for minors.

1 What information we collect about you
We collect information from you on a lawful, reasonable, and necessary basis. When providing a specific service to you, we will clearly inform you of the information we will collect and the purpose for which we will use it to respond to your specific service request. Depending on the service you choose, we may collect one or more of the following types of information in the following scenarios.
1.1 When you bind your battery successfully, the personal center will obtain your personal information in the background, such as your cell phone number or email address, name, address, precise location information and other related information.
1.2 It should be especially noted that separate device information, service log information is information that cannot identify a specific natural person. If we combine such non-personal information with other information to identify a specific natural person or use it in combination with personal information, such non-personal information will be treated as personal information during the period of combined use, and we will anonymize and de-identify such information unless we obtain your authorization or unless otherwise required by law or regulation.
1.3 DAO EV Tech BMS cloud platform service may have third party services. It is up to you to decide whether to access or accept the services provided by the third party, and DAO EV Tech does not provide any form of guarantee or warranty for the availability, authenticity, adequacy or reliability of the third party services. You are advised to exercise caution in determining whether to use the third party services. If you decide to accept the products or services of a third party, the possible results and risks thereof are entirely at your own risk.
1.4 In order to improve the security of your use of DAO EV Tech BMS cloud platform services, to protect you or other users or the public from infringement of personal and property safety, to better prevent phishing sites, fraud, network vulnerabilities, computer viruses, network attacks, network intrusion and other security risks, and to more accurately identify violations of laws and regulations or the rules of DAO EV Tech platform related agreements, we may use or integrate your account information, device interaction information, network log information and information that we have obtained your authorization or shared in accordance with the law to comprehensively determine your account and transaction risks, conduct identity verification, detect and prevent security incidents, and take necessary recording, auditing, analysis and disposal measures in accordance with the law.
1.5 If the information you provide contains personal information of other users, you need to ensure that you have obtained legal authorization before providing such personal information to us. If personal information of children is involved, you need to obtain the consent of the corresponding child’s guardian before publishing, and the guardian in the aforementioned case has the right to contact us through the means of Article 9 of this Agreement to request correction or deletion of the content involving personal information of children.
If we use the information for purposes other than those set forth in this Agreement, or if we use the information collected for a specific purpose for
other purposes, or if we obtain your personal information from a third party on our own initiative, we will obtain your prior consent.
1.6 Exceptions to Obtaining Authorized Consent: You fully understand and agree that your authorized consent is not required for us to collect and use your personal information, and that we may not respond to your requests for correction/correction, deletion, cancellation, withdrawal of consent, or request for information, in the following circumstances.
1.6.1 related to national security, national defense security.
1.6.2 relating to public safety, public health, or vital public interest.

1.6.6 Personal information collected from information that is lawfully and publicly disclosed, such as lawful news reports, government information disclosure and other channels.
1.6.7 as necessary to enter into and perform relevant agreements or other written documents with you.
1.6.8 necessary for maintaining the safe and stable operation of the products and/or services provided, such as detecting and disposing of malfunctions of the products and/or services
1.6.9 Necessary for legitimate press coverage.
1.6.10 necessary for academic research institutions to conduct statistical or academic research in the public interest and to de-identify the personal information contained in the results when providing the results of academic research or descriptions to the public
1.6.11 Other circumstances specified by laws and regulations.
2 How we use your information
2.1 We keep your personal data up to date; store or destroy it securely; minimise the collection and retention of data we need to provide you with our services; protect personal information from disclosure, misuse, unauthorised access and disclosure; and take appropriate technical measures to protect the security of your personal information.
2.2 We use your information for the following purposes.
2.2.1 to provide you with services (device location, device information display, etc.) in accordance with the contract we have with you
2.2.2 To provide other services requested by you in accordance with the requirements stated at the time we collected the information
2.2.3 To share your contact information with company affiliates around the world for internal administration and back office support purposes.
2.2.4 To maintain the integrity and security of our data technology systems that store and process your personal information
2.2.5 To enforce or protect our agreements or contracts with you

2.3 It is important to note that the above uses cover the main ways in which we use your information. From time to time, we may provide more diverse services to our users by, for example, updating our website pages or device firmware. When we use information for purposes other than those described in this Agreement, or when we use information collected for a specific purpose, we will ask for your consent again in the form of a signed agreement, a pop-up alert, an update to this Agreement, etc.
3 Circumstances under which we share your information
We will not share your personal information with companies, organizations and individuals outside of DAO EV Tech, except in the following circumstances.
3.1 Sharing under legal circumstances: We may share your personal information with external parties in accordance with laws and regulations, the need for litigation dispute resolution, or as requested by administrative or judicial authorities in accordance with the law.
3.2 Sharing with explicit consent: We may share your personal information with other parties with your explicit consent or authorization or if you choose to do so on your own initiative.
3.3 Sharing with Affiliates: Your personal information may be shared with our affiliates and/or their designated service providers in order to facilitate our provision of products and services to you, to identify account anomalies, and to protect the personal and property of other users or the public from harm. We will only share personal information that is necessary and subject to the purposes stated in this Agreement, and will again seek your authorized consent if we share your personally sensitive information or if our affiliates change the purposes for which personal information is used and processed.
3.4 Sharing with Authorized Partners: We may engage authorized partners to provide certain services to you or perform functions on our behalf, and we will only share your information for the lawful, legitimate, necessary, specific, and explicit purposes stated in this Agreement, and the authorized partners will only have access to the information they need to perform their duties, and will not use this information for any other purpose. Such processed data may be used and shared without separate notice to and consent from you.
Currently, our authorized partners include the following types.
3.4.1 Suppliers, service providers and other partners. We send information to vendors, service providers and other partners who support our business with technical infrastructure services commissioned by us, analyze how our services are used, measure the effectiveness of our services, provide customer service, facilitate payments, or conduct academic research and surveys.
3.5 We will not transfer your personal information to any company, organization or individual, except as follows.
3.5.1 Transfers where express consent is obtained: we will transfer your personal information to other parties after obtaining your express consent.
3.5.2 In the event of a merger, acquisition or bankruptcy liquidation situation of DAO EV Tech BMS cloud platform service providers, or other situations involving mergers, acquisitions or bankruptcy liquidation, if the transfer of personal information is involved, we will require the new company or organization holding your personal information to continue to be bound by this Agreement, otherwise we will require the company, organization and individual to seek authorized consent from you again.
3.5.3 Exceptions to the requirement to obtain prior authorized consent for sharing, transferring, or disclosing personal information shall be implemented in accordance with the requirements of the relevant laws and regulations currently in effect.
If you do not agree to our providing your personal information to third parties in accordance with the above terms, please stop using our platform services immediately.
4 How we store your information
Unless otherwise provided by law, DAO EV Tech BMS Cloud Platform will store your information for the following periods.
4.1 We will continue to store it for you for the duration of your use of DAO EV Tech BMS Cloud Services unless you voluntarily delete your DAO EV Tech BMS Cloud Platform account.
4.2 When you delete your information, DAO EV Tech BMS Cloud Platform will stop using your personal information and delete your personal information promptly within a certain period of time.
4.3 After your personal information is anonymized and desensitized, it will form a circulating data that can be used, and DAO EV Tech BMS Cloud Platform does not need to obtain your consent to store and use this data separately.
5 How we protect your information
5.1 We have taken reasonable and practicable security measures, consistent with industry standards, to protect your information from unauthorized access, public disclosure, use, modification, damage or loss. 5.2 The Internet is not an absolutely secure environment, and when using DAO EV Tech BMS Cloud Platform services, we strongly recommend that you do not use communication methods other than those recommended by the DAO EV Tech platform to send your information. You can connect and share with each other through our services. When you create communication, transaction or sharing through our service, you can independently choose the person to whom you communicate, transaction or share as a third party who can see your transaction content, contact information, communication information or sharing content and other related information.
5.3 After the unfortunate occurrence of a personal information security incident, we will inform you in accordance with the requirements of laws and regulations: the basic situation of the security incident and the possible impact, the disposal measures we have taken or will take, the suggestions you can independently prevent and reduce the risk, the remedial measures for you, etc. We will inform you by email, letter, telephone, push notification, etc. When it is difficult to inform the subject of personal information one by one, we will take a reasonable and effective way to publish the announcement. At the same time, we will also report the disposition of personal information security incidents in accordance with the requirements of regulatory authorities.
6 The rights you enjoy
You have the right to manage your information, including
6.1 Access to your personal information.
6.1.1 Account information: If you wish to access or edit your profile information in your account, change your password, etc., you can access your information through the settings after logging into your account.
6.1.2 For personal information generated in the course of your use of our products or services, you may contact us through the contact information in section 9.1 if you need to do so.
6.2 Correction of your personal information
When you discover an error in our handling of your personal information, you have the right to ask us to make corrections or additions. You can make corrections or additions by visiting the personal information settings page or by contacting us directly.
6.3 Deletion of your personal information
You may request deletion of your personal information by contacting DAO EV Tech Platform Customer Service in the following cases.
6.3.1 If our handling of personal information violates laws and regulations.
6.3.2 If we collect and use your personal information without your explicit consent.
6.3.3 If our handling of personal information is in serious violation of the agreement with you.
6.3.4 If you do not need to use our products and services, or if you voluntarily cancel your DAO EV Tech BMS Cloud Platform account.
6.3.5 If there is no permanent need for our BMS cloud platform services.
If we decide to respond to your request for deletion, we will cease providing the BMS Cloud Platform services to you and delete your personal information as required by applicable law.
7 Cancellation of personal information subject account
7.1 If you need, you can contact us through the contact information in Article 9.1 to cancel your BMS Cloud Platform account for personal information or enterprise information subject.
7.2 After you cancel your BMS Cloud Platform account, we will stop providing BMS Cloud Platform services to you and delete your personal information according to your request.
8 How to protect the information of minors
8.1 DAO EV Tech BMS cloud platform services are mainly for adults. In the case of personal information collected from minors with the consent of their legal guardians, we will only use or publicly disclose the personal information legally collected from minors as permitted by law, with the express consent of their legal guardians, or as necessary to protect them.
8.2 If we discover that personal information of a minor has been collected without the prior consent of the legal guardian, we will seek to delete the relevant data as soon as possible. If a legal guardian has reason to believe that a minor has submitted personal information to the DAO EV Tech BMS Cloud Platform without their prior consent, please contact us to ensure that such personal information is deleted and that the minor unsubscribes from any applicable DAO EV Tech BMS Cloud Platform services.

9.2 For security purposes, you may need to provide a written request or otherwise prove your identity. We will normally respond within 15 days.
9.3 This Agreement is entered into at Pune, Maharashtra, India. The laws of India shall apply to the entry into force, performance, interpretation and resolution of disputes and all disputes, claims or other matters arising out of or in connection with your use of the DAO EV Tech Platform or Services. All disputes arising between you and DAO EV Tech or the DAO EV Tech Platform shall be amicably negotiated, and if such negotiation fails, either party may submit the dispute to the local court, whose decision shall be final and binding on all parties.
